Terms of Service
These terms cover your use of truedigitalpro.com and the services Digital Solutions provides. Please read them carefully. By using the site or engaging our services, you agree to them.
The short version
- Your proposal or statement of work sets out what we'll do and what it costs. Where it conflicts with these terms, the proposal wins.
- No one can guarantee rankings, traffic or AI citations, and we don't. Search engines and AI platforms are controlled by third parties.
- Unless your proposal says otherwise, engagements are month to month, and either side can end them with 30 days' written notice.
- Work you've paid for in full belongs to you.
1. About these terms
Digital Solutions is a sole proprietorship based in Mumbai, Maharashtra, India. "We", "us" and "our" mean Digital Solutions; "you" means the person or business using our website or services.
When you engage us, the specific work is described in a written proposal, quote or statement of work (the "Proposal"). The Proposal and these terms together form our agreement. If they conflict, the Proposal takes priority.
2. Using this website
The content on this website is general information about our services. It isn't professional advice for your specific situation. We may update, change or remove any part of the site at any time.
You agree not to misuse the site. That includes attempting to gain unauthorised access, interfering with how it works, scraping it in bulk, or using it for anything unlawful.
3. Our services
We'll provide the services described in your Proposal with reasonable skill and care, following accepted industry practice and the guidelines of the platforms we work on. We use white-hat methods only, and we won't knowingly do anything that breaches search-engine or platform guidelines.
Work outside the Proposal's scope is quoted separately before we start it.
4. No guarantee of results
Search rankings, traffic, leads, AI-assistant citations and advertising performance depend on factors we don't control. These include the algorithms and policies of Google, Microsoft, OpenAI, Perplexity and other platforms, your competitors' activity, market conditions and your own website and business.
We therefore don't guarantee any specific ranking, position, citation, traffic level, lead volume or revenue. Any forecasts or estimates we give are our good-faith opinion, not a promise. Be wary of anyone who guarantees first-page rankings.
5. Your responsibilities
- Give us accurate information and timely access, feedback and approvals. Delays on your side may delay results.
- Make sure you own, or have permission to use, any content, images, trademarks and data you give us.
- Make sure your products, services, claims and advertising comply with the law and with platform policies.
- Keep your own backups of your website and data. We take care when making changes, but you're responsible for maintaining backups.
6. Fees and payment
- Fees, billing frequency and payment terms are set out in your Proposal. Fees exclude applicable taxes unless stated.
- Advertising spend (for example Google Ads) is paid by you directly to the platform unless we've agreed otherwise in writing. It is separate from our management fees.
- If an invoice is overdue, we may pause work until it's paid.
- Fees already paid are non-refundable for work performed, except where the law requires otherwise.
7. Term and cancellation
Unless your Proposal says otherwise, engagements run month to month. Either of us can end the engagement with 30 days' written notice. Fixed-scope projects end when the project is delivered.
Either of us may end the engagement immediately if the other seriously breaches these terms and doesn't fix the breach within 14 days of being told about it. On termination you pay for work done up to the end date, and we hand over any completed deliverables you've paid for.
8. Intellectual property
- The content, design and branding of this website belong to us or our licensors.
- Once you've paid in full, you own the deliverables we create specifically for you, such as content, reports and campaign assets.
- We keep ownership of our pre-existing tools, templates, processes and know-how. You receive a licence to use them as part of your deliverables.
- We may mention that you're a client, for example on our website, unless you ask us not to. We'll never publish your confidential results without permission.
9. Third-party platforms
Our work often depends on third-party platforms such as Google, Microsoft, Meta and AI-assistant providers, and on hosting providers. Your use of those platforms is governed by their own terms. We aren't responsible for their outages, algorithm or policy changes, or account actions such as suspensions or disapprovals.
10. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for our work together. This doesn't apply to information that's already public, that was independently obtained, or that must be disclosed by law. These obligations continue after the engagement ends. Personal information is handled as described in our Privacy Policy.
11. Limitation of liability
This website is provided "as is". To the fullest extent permitted by law, we aren't liable for indirect or consequential losses, including lost profits, lost revenue, lost data or loss of goodwill.
Our total liability arising from our services is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing in these terms limits liability that can't legally be limited, such as liability for fraud.
12. Indemnity
You agree to cover our reasonable losses arising from third-party claims about content or materials you supplied, or about your products, services or business practices.
13. Governing law
These terms are governed by the laws of Maharashtra, India. The courts of Maharashtra, India have exclusive jurisdiction over any dispute, although we'll always try to resolve concerns informally first.
14. General
- We may update these terms from time to time. The version shown here, with its "Last updated" date, applies from that date. Changes don't affect work already agreed in a signed Proposal.
- If any part of these terms is found unenforceable, the rest remains in effect.
- Failing to enforce a right doesn't waive it.
- These terms and your Proposal are the entire agreement between us about their subject.
